A report of possible animal neglect

On 01/13/2024, officers with the Village of Bath Police Department received a report of possible animal neglect that had occurred at 11 E William Street in the Village of Bath.

Subsequent to an extensive investigation, the following subjects were arrested and each were charged with 8 counts of Agriculture and Markets Law 353 – Overdriving, torturing and injuring animals; failure to provide proper sustenance, a class A misdemeanor.
• Joshua A. Fenstermacher, age 36, of Bath
• Ashley K. Odonnell, age 36, of Bath
• Eva-Rose J. Brush, age 24, of Bath

It is alleged that Fenstermacher, Odonnell and Brush failed to provide proper sustenance in the form of food, water and veterinary care, to 8 dogs in their care, resulting in several dogs becoming deathly ill, and resulting in the death of 1 of the 8 dogs.

Brush was further charged with one count of Agriculture and Markets Law 356 – Failure to provide proper food and drink to an impounded animal, an unclassified misdemeanor. It is alleged that Brush abandoned a cat in a condemned apartment without proper food or water.

Fenstermacher, Odonnell and Brush were transported to Steuben County Jail for CAP arraignment where they were arraigned and released on their own recognizance.

All animals remain in the care and custody of animal rescues while this case is handled in court.
