On Saturday, June 29th, 2024, DAVID C. CERVANTES, age 38, of Spencerport, New York, was arrested and charged with Assault in the second degree, a Class D felony.
On Saturday, June 29th, 2024, at or about 11:37AM, EMS was dispatched to 510 Howell Street for a medical call. A sergeant and an officer responded to the scene to assist Bath Ambulance. The patient, DAVID CERVANTES, became non-compliant and swung an elbow attempting to strike the sergeant. During a brief physical altercation, CERVANTES kicked the sergeant in the head causing physical injury. CERVANTES was placed under arrest and transported via Bath Ambulance to Ira Davenport Hospital where he was found to be under the influence of methamphetamine and later released. CERVANTES was then transported to Bath Police Department for arrest processing and subsequently transported to Steuben County Jail to be arraigned at CAP court. CERVANTES was released at CAP court and is to appear at a later date.
The sergeant injured was evaluated by medical professionals and suffered trauma to the head. The Village of Bath Police Department was assisted by Bath Ambulance.
